1. Who you are contracting with

These Terms & Conditions are a legal agreement between you and RFE Insight (“we,” “us,” or “our”). RFE Insight provides an automated analysis service for EB-1A and EB-2 NIW Requests for Evidence, Notices of Intent to Deny, and related denial notices.

2. Acceptance of terms

By accessing or using the service, you agree to these Terms. If you do not agree, do not use the service. You must have the authority to accept these terms on behalf of yourself or the organization you represent.

3. The service

RFE Insight reads a USCIS Request for Evidence, Notice of Intent to Deny or denial notice that you upload, as a PDF or as images of the pages, and generates a structured report explaining what the notice is asking for and what responses to findings of that kind usually contain, in light of current practice and data. The report is delivered by email as a PDF.

The service is an informational tool only. It does not perform legal analysis, provide legal advice, direct your response, predict outcomes, or create an attorney-client relationship. You should consult a licensed attorney for advice on your own case.

4. Payments

Our order process is conducted by our online reseller and Merchant of Record, Freemius. Freemius securely processes your payment information, including international card transactions, and handles the technical checkout flow. We do not store your full card details.

Freemius is the seller of record for your purchase and appears on your statement. Payment, billing, and refund mechanics are governed by Freemius's terms and applicable card-network rules. The current price for one analysis is $29.99 USD. We may change pricing at any time for future purchases.

5. Acceptable use

You agree not to misuse the service. Prohibited conduct includes, but is not limited to:

• Using the service for unlawful purposes or to violate any applicable law.
• Uploading fraudulent, forged, or misleading documents.
• Spamming, abusing, or overloading the service infrastructure.
• Infringing intellectual property rights or other proprietary rights.
• Attempting to reverse engineer, scrape, probe, or interfere with the security or operation of the service.
• Using the service to provide legal advice to third parties.

6. Intellectual property

RFE Insight owns all rights, title, and interest in the service, its software, reports generated by the service for your personal use, branding, and documentation. You are granted a limited, non-exclusive, non-transferable right to use the service for your own immigration matter. You may not resell, redistribute, or commercially exploit reports generated by the service for others.

7. Service availability

We do not guarantee uninterrupted or error-free performance. The service may be unavailable for maintenance, updates, or reasons beyond our control. We are not responsible for any deadline you may miss as a result of using or being unable to use the service.

8. Disclaimers

The service is provided “as is” and “as available.” We disclaim all warranties, express or implied, to the fullest extent permitted by law, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of liability

To the fullest extent permitted by law, RFE Insight's aggregate liability shall not exceed the amount you paid for the service in the twelve months preceding the claim. We are not liable for indirect, consequential, or special damages, including lost profits, data, or goodwill, even if advised of the possibility. Nothing in these terms limits liability for fraud, death, or personal injury where required by law.

10. Suspension and termination

We may suspend or terminate your access to the service for material breach of these Terms, non-payment, security risk, fraud, or repeated or serious policy violations. On termination, your right to use the service immediately ends.

11. Indemnity

You agree to indemnify and hold RFE Insight harmless from claims arising out of your use of the service, your uploaded documents, or your violation of these Terms.

12. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict of laws principles. Any dispute shall be resolved in the courts located in San Francisco County, California.

13. Changes to these terms

We may update these Terms from time to time. The current version will always be posted on this page with the effective date. Continued use of the service after changes means you accept the updated Terms.
